BY SUBMITTING THE BOOKING REQUEST (REGISTRATION) AND MAKING BOOKINGS ON OUR WEBSITE, YOU AGREE TO OUR BOOKING GUIDELINES BELOW:
These general terms and conditions apply to all bookings, unless otherwise specified.
Please read the terms carefully so that you understand everything.
1. YOUR CONTRACT
We act as a booking agent for the providers (owners, local agents, organizers) of the “individual components” of the vacation we organise (i.e. accommodation, rental of holiday homes, etc.), and therefore booking your services creates a DIRECT CONTRACT BETWEEN YOU AND THE RELEVANT PROVIDER (i.e. between owner, local agent or tour operator).
The basis of the brokerage contract is Italian law and the place of jurisdiction in Italy.
Customer money is received on behalf of the service provider.
By booking and registering on our website or by sending us the completed booking form, you confirm your booking, accept the terms and conditions on behalf of your travel group and must pay the amounts due. The following cancellation conditions therefore apply.
2. BOOKING PROCEDURE
You can initiate a booking directly on our website, by submitting an enquiry online on one of our websites or by e-mail. Submitting the completed booking form by email is considered a binding reservation.
3. PAYMENT
To confirm your booking, a deposit of 30% of the rental price must be paid when booking, unless otherwise agreed. We accept payments via Visa/Mastercard/American Express credit card or bank transfers. The remaining amount is due no later than 30 days before departure via bank transfer or credit card. Additional costs must be paid in cash at your holiday destination, unless otherwise agreed. Unless we receive all payments due in full and on time, we reserve the right to consider your booking as cancelled by you and will be subject to the following cancellation fees.
4. CHANGES ON YOUR PART
If you would like to make any changes to your confirmed booking, you must notify us as soon as possible. We will do our best to make such changes, but we cannot guarantee that all requests can be accommodated. We only accept changes to a confirmed booking, provided that a change to the holiday property is not affected. The rebooking fee is based on the additional price for the new booking plus a rebooking fee of EUR 80. A refund for unused days is based on the applicable cancellation fees, see clause 5
5. WITHDRAWAL FROM YOUR SIDE
Should you be forced to cancel your booking for any reason, you must immediately notify us in writing. Your cancellation notice will only be effective if we receive it in writing. The amount of the cancellation fee depends on the date on which you notify us of your cancellation. Unfortunately, we cannot allow any exceptions to the cancellation policy, even in the event of personal emergencies. 6. MINIMUM RENTAL PERIOD The minimum rental period is usually one week, in high season from Saturday to Saturday, unless otherwise agreed with the rental agency. Reservations for fewer nights are occasionally possible and depend on the availability of short breaks between regular reservations. The prices listed on our website are listed in euros per week for a holiday property.
7. ARRIVAL AND DEPARTURE
Unless otherwise stated, check-in for your rental property is available between 16:00 - 20:00 on the day of arrival. Depending on the holiday property, a late check-in fee may be charged. The time of arrival and access must be confirmed via our agency with the owner/key holder. As soon as your booking is confirmed, your arrival time (check-in) will also be confirmed. We are happy to arrange for the accommodation to be taken over at any time, but please avoid early or late check-in. The holiday property must be vacated by 10.00 a.m. on the agreed departure date. The key holder or owner must be notified of an early check-out in order to be able to ensure that the holiday property is checked and the deposit is refunded. In the event of an unavoidable delay on the day of arrival, you must immediately inform us and/or the key holder named on your arrival details. If we are not notified or are unable to accept a late arrival, you are responsible for the costs and booking an overnight stay at a hotel. If you are unable to arrive on the specified day, no refund will be required. This also applies in case of early departure. In this case, the key manager or owner is forced to visit the holiday property unscheduled and reimbursement of expenses can be claimed. On arrival, you must present your reservation form and a passport or ID to enable registration in accordance with legal requirements. The number of guests must not exceed the number confirmed when booking. We must be notified of any changes to the names and number of guests at least 48 hours before arrival. The number of guests must be confirmed by us. If the number of confirmed guests is exceeded, the owner/local agent or key holder is entitled to refuse access to the holiday property. We assume no further responsibility and a refund is excluded.
8. INSURANCE
You are strongly recommended to take out personal travel and travel cancellation insurance for all members of your travel group. You are responsible for ensuring that the insurance you take out meets your individual needs. Please read your insurance contract details upon receipt and take the documents with you on vacation.
9. BEHAVIOR
By confirming your booking, you assume responsibility for the correct and orderly conduct of your travel group. Neighbors and other people must also be considered. If, in our opinion, you or a member of your travel group behaves in a way that entails a risk, disruption or impairment of a third party or damage to the holiday property, we are entitled to terminate the rental agreement without prior notice. We accept no further responsibility and a refund is excluded. You must ensure that the holiday home and all household items and appliances are handled with care and returned in the same condition as they were found. Any damage or breakage must be reported to the responsible agent or directly to us as soon as possible. You are liable for any loss, breakage, or damage caused to the holiday property or the objects in it. The owner reserves the right to charge you the appropriate amount.
10. ACCOMMODATION
The holiday properties are reserved exclusively for those persons named in the reservation form. Other people are not allowed to stay unless this has been agreed with us. If the holiday property is occupied by a smaller number of people, no refund will be required. *Important note: As you know, the holiday properties offered on our website www.maremita-villas.com are not official tourist resorts, such as hotels, holiday apartment complexes, etc., but private accommodation. As a result, they do not meet internationally recognized standards or categories, but rather reflect the local traditions and personal taste of the owner with their construction and equipment. We offer you the opportunity to enjoy the culture in the region and live together with the local population. So that you can enjoy this experience in the right mood, it is important that you accept and appreciate the characteristics of the holiday property in contrast to the official tourist facilities. Due to the long summers, water can become scarce. Please use water as sparingly as possible. Please do not use too many electrical devices at the same time, as this may result in an interruption of the power supply. The owners or responsible agencies of the holiday properties reserve the right to unrestricted access to the holiday property if important maintenance work is required. Unless otherwise specified, bringing pets into the holiday properties is not allowed.
11. CLEANING
The holiday property will be handed over to you in a clean, well-maintained and tidy condition. You must pay the amount due for the final cleaning in euros, unless otherwise agreed. Cleaning the kitchen equipment, dishes, cutlery, kitchen corner/kitchen/kitchenette and waste disposal are your tasks and are not included in the final cleaning. If you neglect cleaning, we reserve the right to charge you an additional amount.
12. COMPLAINTS AND PROBLEMS
If there are problems with the holiday property or if you have a reason to complain during the rental period, you must inform the provider, i.e. the owner/agent. You are required to give the provider at the holiday destination the necessary time to fix the problem. Any compensation and/or travel price reduction claims arising from the rental relationship are excluded against Maremita Villas as an intermediary. In this case, Italian law and the place of jurisdiction in Italy apply. Notifications of defects to the landlord after the end of vacation are excluded. In the event of force majeure (natural disaster, war, strike, etc.), the landlord reserves the right to cancel the concluded rental agreement. The rent payments made to the landlord directly or through the agent will be refunded by the landlord. Any further claims are excluded.
13. LIABILITY
We are not responsible or liable for omissions by third parties that could prevent or interfere with a booking. The contract is between the provider and you and is limited exclusively to the rental of the holiday property and the associated services. We cannot accept liability for injuries, illnesses, death, loss, or damage in connection with you or any member of your travel group arising out of or in connection with the use of the rental property, swimming pool, children's play areas, or any type of sports facilities. Use of these facilities is at your own risk. We are not liable for damage or loss resulting from burglary.
14. FORCE MAJEURE
Maremita Villas assumes no liability insofar as the contract is affected by “force majeure”. For the purposes of these conditions, “force majeure” means an event that we cannot foresee or avoid even with due care. Such events include wars, threats of war, riots, riots or unrest, hostilities, industrial disputes, natural disasters, fires, accidents, terrorist attacks, nuclear disasters, adverse weather conditions, government measures, technical transportation problems, or other events beyond our control.
